Privacy Policy

1. Scope
McRoberts Law (our office, we, or us) respects your privacy. This policy explains how our family law office collects, uses, maintains, and shares information received through our website, intake forms, client portal, and related communications. It also explains our requirements for submitting documents securely.

2. Information We Collect

We may collect information you provide when you contact our office, complete an intake form, request a consultation, or use our client portal. Depending on your interaction with us, this may include your name, contact information, information about your legal matter, and documents or records you provide.

Information submitted in connection with legal services may include sensitive personal, financial, family, employment, health, and identifying information. Please provide only information relevant to your inquiry or requested by our office. Do not submit Social Security numbers, financial account numbers, medical records, or other sensitive information through a general website contact form.

3. How We Use Information

We use information to respond to inquiries, evaluate potential representation, check for conflicts of interest, provide requested legal services, communicate with clients, administer billing and office operations, protect our systems, and meet applicable legal and professional obligations.

Submitting an inquiry or completing an intake form does not, by itself, establish an attorney-client relationship. Please do not assume that our office has agreed to represent you or protect a deadline unless our office confirms the representation.

4. Disclosure of Information

We may share information with service providers that support our legal practice, such as client-portal, document-storage, technology, and payment-processing providers, as needed to perform their services. In providing legal services, we may also disclose information as authorized by the client or as permitted or required by applicable law and professional obligations, including disclosures needed for filings, discovery, and communications with other participants in a matter.

5. Mandatory Client-Portal Document Submission

Clients must submit any and all documents to our office through the client portal designated by our office. This requirement applies to documents of every kind, including photographs, screenshots, text-message exports, audio and video files, financial records, tax returns, discovery materials, medical records, and signed documents.

Do not send documents as ordinary email attachments, by text message, through social media, through a general website contact form, or through an outside file-sharing link unless our office expressly approves an alternative method in advance. Email may be used to notify our office that you uploaded documents, but do not attach the documents or include sensitive information in the notification.

Upload complete, legible files and retain your originals. Do not upload passwords with the documents they protect. Contact our office for instructions if a file is too large, you cannot access the portal, you need an accessibility accommodation, or our office needs a physical original. Our office will arrange an approved alternative when necessary.

A successful upload does not confirm that an attorney has reviewed a document, agreed to take action, or accepted a deadline. If a document concerns an upcoming deadline or urgent issue, upload it and contact our office promptly by telephone. Do not rely on a portal upload alone for emergency assistance.

6. Encryption and Security Standards

Verification required before publication: The following paragraph states proposed minimum standards. Publish it only after confirming that the client portal, storage systems, backups, and approved transfer methods meet these requirements. If they do not, implement the standards or revise the paragraph to describe the verified safeguards accurately.

Our office requires approved systems used to transmit and store client documents to use the following encryption standards:

  • In transit: Transport Layer Security (TLS) version 1.2 or later, with TLS 1.3 preferred where supported and securely configured.

  • At rest: Advanced Encryption Standard (AES) with 256-bit keys, or a documented equivalent-strength encryption method, for stored client documents and backups.

  • Alternative transfers: Any separately approved electronic transfer must use an encrypted transfer service or an encrypted file with a strong, unique password communicated through a separate channel. Password protection alone is not treated as proof that a file is encrypted.

Encryption in transit and at rest does not necessarily mean end-to-end encryption. Authorized personnel and service providers may be able to access information as needed to provide services. No electronic system, transmission method, or storage system is completely secure, and we cannot guarantee absolute security.

Clients must use a strong, unique portal password, enable multifactor authentication when available, keep login credentials private, and avoid accessing the portal from shared or untrusted devices. Do not share access with another person without first contacting our office. Notify our office promptly if you suspect unauthorized access or believe you sent information to the wrong recipient.

7. Retention and Disposal

We retain information according to the purpose for which it was collected, our applicable records-retention practices, and relevant legal and professional obligations. A legal hold or other obligation may require longer retention. When information is eligible for disposal, we use disposal methods appropriate to its sensitivity and the systems involved.

The client portal is not a permanent personal archive. Keep your own copies of documents and contact our office about access to your file before representation ends or portal access is discontinued.

8. Requests and Privacy Concerns

Contact our office if you have a privacy concern, need to correct your contact information, or wish to request access to or deletion of information. We may need to verify your identity. Our response depends on applicable law, professional obligations, and any requirements to retain or protect records. This policy does not promise deletion of records that our office is required or permitted to retain.

9. Third-Party Websites

Our website may link to websites or services operated by others. Their privacy policies and practices govern information you provide directly to them. Review those policies before submitting information.

10. Changes to This Policy

We may update this policy as our practices, technology, or obligations change. We will post the revised policy with an updated effective date and provide additional notice when required.
